Partner Program’s Terms of Service

Website visits via your Partner Link, signups and purchases are tracked in the most fair way possible

1. Introduction

Please read this Terms of Service attentively before applying for Partner Account or sharing your partner link.

Using your Partner Link will be considered that you accept these Terms of Service and agree to adhere to a policy.

If you do not agree to this Terms of Service, you must not participate in the Partner Program.

This is the agreement between you (referred to as a “Partner”, “Affiliate” or “Affiliate Partner”) and Anatoli Makarevich (referred to as “SQL Habit”).

2. The subject of this Agreement

The subject of this Agreement is sharing links (copy, images or other creative materials) to the SQL Habit website (www.sqlhabit.com) by Affiliate on websites owned or controlled by you, emails or social media sent by you and clearly identified as coming from you and in online advertisements (later referred to as “Affiliate Media” or “Partner Media”).

3. Modification

The terms of this Agreement could be modified at any time by SQL Habit. Changes could be applied to fees, the payout schedule, or other terms of the Agreement. Participation in the Partner Program is considered as your acceptance of any changes to the Agreement.

4. Enrollment

To enroll in the Partner Program you need to send an email to partner@sqlhabit.com. In this email:

introduce yourself
describe where and how you’ll share your Partner Link
choose your unique ref parameter
select how you want to receive payments (Paypal or Bank transfer)

Your application will be reviewed asap and you’ll be notified via email about the approval.

5. Partner URL

Every approved Partner account has a special link. That is your unique “Partner Link” (or “Partner URL”). For example, https://www.sqlhabit.com/?ref=foobar.

foobar in this example URL is the unique identifier of your Partner Account.

It’s unique amoung partners and should be set up once and for all right after your Partner account is approved.

6. Tracking

Every click on your Partner Link is tracked via SQL Habit internal analytics systme. If someone follows your Partner Link and signs up on SQL Habit within 30 days it’ll be tracked and shown in your Partner Dashboard. Let’s call these signups “Partner Signups”.

All purchases of SQL Habit licenses (personal, students, or teams) from your Partner Signups will be tracked and shown in your Partner Dashboard.

7. Commissions

Partners receive 30% of the revenue coming every purchase of the SQL Habit course (personal, student or team) done by Partner Signups (definition of a Partner Signup is in the 6. Tracking).

30% commissions are paid only when SQL Habit customers click through a correct Partner Link (correct link has a ref parameter with Partner’s unique identifier, like https://www.sqlhabit.com/?ref=foobar).

Sharing correct Partner Links is the sole responsibility of the Partner.

8. Payouts

Payouts to Partners are done via Paypal or bank transactions (IBAN) on the 1st of every month.

Partners are responsible for providing valid Paypal email/identifier or IBAN.

The minimum payout amount is 150EUR. Your affiliate commissions will never expire and accumulate until they reach the minimum payout amount.

9. Partner Obligations

Display Partner Links for the purpose of this Agreement.

Have sole responsibility for producing and operating Partner Media (all the links, emails, social posts, etc).

Ensure that Partner Media is not breaking any copyright or 3rd party intellectual property.

Ensure that Partner Media does not have any harmful/sexually explicit/harassing content.

Ensure that Partner Media does not promote any illegal activity.

Not make any statements on behalf of SQL Habit.

Make sure that Partner Media does not look similar to SQL Habit website or other SQL Habit materials.

Not place any Partner Links to auction/discount platforms.

Comply with all obligations/restrictions under this Agreement and laws/rules that regulate your business, your Partner Media or your use of Partner Links.

Comply with terms and policies of used email providers, social networks or any used 3rd party service providers.

10. Partner Email Campaigns

If you’re sharing your Partner Links via an email campaign, you need to make sure it’s clear that you’re (the Partner) is the publisher of such an email campaign.

Partner is solely responsible for such email campaign. Partner shall indemnify and hold SQL Habit free and harmless upon first request from and against any and all liability and claims arising from the Partner email campaign which are asserted by any third party (including the imposition of fines and penalties by public authorities) against SQL Habit. This indemnity shall extend to the costs for the legal defense against third party claims, including the costs for negotiations, settlements, and legal remedies.

11. Permitted usage of SQL Habit materials

Contact SQL Habit at partner@sqlhabit.com in case you’re needed SQL Habit brand materials.

12. Prohibited usage of SQL Habit materials

Partners may not use any “brand” keyword in marketing or SEO campaignsPartners may not promote their links on Facebook, Quora, Linkedin, Instagram or Twitter.Partners may not use SQL Habit logo or any SQL Habit website materials to indicate they’re officially affiliated or partnered with SQL Habit.

Partners may not use any variation of words “SQL Habit” in their website URLs (sqlhabitoffer.com, sqlhabit.org, etc).

Partners may not promote any discount coupons that were not provided them personally by SQL Habit. If you want to promote a coupon – contact SQL Habit at partner@sqlhabit.com and we’ll figure it out.

13. Anti-spam policy

SQL Habit strictly prohibits Partners from using email spam or other forms of Internet abuse (including spamming forums, blogs, Twitter, Facebook, or other social media websites) to seek sales. Spam is defined as including, but not limited to, the following:

Emails (or SMS, Push Notifications, any form of electronic communication) sent to recipients with whom Partner does not have a personal or business relationship and who actively consented to be Partner’s recepients.

Messages posted to social networks or forums that are off-topic or breaking the forum policies. If a forum owner or moderator complains about illegal forum usage your Partner may be permanently terminated. Comments posted on blogs or other websites that violate comment policy or done with the sole purpose of keyword spamming. Comments or messages posted in free chats.

SQL Habit may at any point terminate a Partner account upon the receipt of a complaint. SQL Habit may investigate the complaint and then terminate a Partner account.

Termination results in the immediate closure of the Partner and SQL Habit accounts, loss of all Partner Signups, and the forfeiture of any unpaid payouts.

If you wish to report a violation of SQL Habit Anti-Spam Policy, please forward all relevant evidence to partner@sqlhabit.com.

13. Relationship of Parties

Partners are independent contractors. Nothing in this Agreement will create any joint venture/franchise or employment relationship between the parties.

Partners have no authority to make or accept any offers or representations on behalf of SQL Habit.

Partners will not make any statement, whether on their sites or otherwise, that reasonably would contradict this statement.

14. Order Fulfillment

SQL Habit is solely responsible for processing payments from Partner Signups. Partners are not authorized to collect any payment or sell SQL Habit course from any other website other than www.sqlhabit.com.

Partners are not authorized to sell SQL Habit licenses on eBay or other websites. Partners are not authorized to give away any of the SQL Habit course material.

SQL Habit is solely responsible for customer support. Partners should understand that there’re no physical products that will be shipped.

Customers who purchase products and services through SQL Habit Partner Program will be deemed to be customers of SQL Habit. SQL Habit may change policies and operating procedures at any time. Prices and availability of SQL Habit products and services may vary from time to time. SQL Habit policies will always determine the price paid by the customer.

15. Termination

Signing up for SQL Habit Partner Program equals to accepting the terms of this Agreement. Either SQL Habit or the Partner may terminate this Agreement at any time, with or without cause.

Upon the termination of this Agreement for any reason, Partner must remove all links to SQL Habit website from Partner Web Sites. All Partner Media in connection to the SQL Habit Partner Program must be removed from the Internet.

16. Liability

SQL Habit will not be liable for indirect, special, or consequential damages (or any loss of revenue, profits, expenditures, or data) arising in connection with this Agreement or Partner Program.

Further, our (SQL Habit) aggregate liability arising with respect to this Agreement and the Partner Program will not exceed the total commissions paid or payable to the affiliate under this Agreement.

17. Disclaimers

We make no express or implied warranties or representations with respect to the Partner Program or a Partner’s potential to earn income from the Partner Program.

In addition, we make no representation that the operation of the websites or the Partner Links will be uninterrupted or error-free, and SQL Habit will not be liable for the consequences of any interruptions or errors.

18. Miscellaneous

Our (SQL Habit) failure to enforce your strict performance of any provision of this Agreement will not constitute a waiver of our right to subsequently enforce such provision or any other provision of this Agreement.

If any of the provisions of this Agreement are determined by a court to be unenforceable, they shall be severed from this Agreement, and the remaining provisions shall remain in full force and effect.

By signing up with the SQL Habit Partner Program, you acknowledge that you have read this agreement and agree to all its terms and conditions.
