Please read this Terms of Service attentively before using the SQL Habit website located at https://www.sqlhabit.com. Using SQL Habit website will be considered that you accept these Terms of Service and agree to adhere to a policy.

1. Object and Validity of these TOS

Anatoli Makarevich (“SQL Habit”, “Select From Count EU”, “us”, “we”, or “our”) operates the sqlhabit.com website (the “Service”).

SQL Habit’s Terms of Service (the “TOS”) set out the legal basis for your use of SQL Habit’s services, and we want you to know your and our rights before you use the SQL Habit website or Services.

Please be aware that if you subscribe to our services for a term (the “Initial Term”), then the terms of your subscription may be automatically renewed for additional periods of the same duration, unless you cancel your subscription in accordance with Section 10 below.

Please take a few moments to read through these TOS:

  1. The legal entity behind SQL Habit

    (hereinafter referred to as “SQL Habit”) operates an online learning platform that provides courses and tutorials for mastering Data Analysis with SQL. The platform is accessible through the internet portal http://www.sqlhabit.com. SQL Habit’s courses and content are designed to help users build SQL expertise through practical exercises and structured learning paths. Users have the opportunity to subscribe to SQL Habit on a monthly or yearly basis to access all courses and features.

  2. The use of the Platform shall be subject to the following TOS in the version valid at the time of your registration or order, or as amended from time to time in accordance with Section 14. SQL Habit does not accept any deviating general terms and conditions from you unless SQL Habit agrees to their validity in writing.

  3. These TOS, together with the specific information provided as part of the registration (see Section 3), when ordering a paid subscription (Section 4), constitute the complete user contract. The provided information is saved by SQL Habit and is available in your user account at any time.

  4. You accept the validity and applicability of these TOS when registering or purchasing a paid subscription, as the case may be.

  5. These TOS also apply, with specific exceptions detailed in each case, if your SQL Habit account is provided through an enterprise agreement (team subscription) or similar arrangement with your employer.

2. SQL Habit’s Services and Rights

  1. SQL Habit offers an online learning platform designed to help users master Data Analysis with SQL through interactive exercises, lessons, and other educational content (the “Platform Content”). This content allows users to build and enhance their data skills in a structured and practical manner. Depending on the features available, SQL Habit may also provide a personalized dashboard where users can track progress, bookmark content, and organize materials into categories and lists. Additional features or materials may be offered for purchase on the platform.

  2. The scope of the Platform Content and the features accessible to you (the “License”) depend on the type of subscription you choose. SQL Habit distinguishes between free accounts (see Section 3) and paid subscriptions (see Section 4). The License duration is tied to the validity period of the subscription. Once your subscription ends, access to the Platform Content will cease unless renewed. Purchased individual content, if offered, will remain accessible indefinitely unless otherwise specified in Section 6.

  3. All rights to SQL Habit’s services and the content provided through the platform remain the property of Select From Count EU and/or its licensors. The Platform Content is typically protected by copyright laws and is provided for personal, non-commercial use. Redistribution or sharing of this content is not permitted. SQL Habit grants you a non-exclusive, time-limited, and personal right to use the platform and its content within the agreed terms of your subscription. When using SQL Habit, you must adhere to the Acceptable Use Policy.

  4. All SQL Habit trademarks, including trade names, logos, domain names, and other distinctive branding features, are the exclusive property of Select From Count EU. The License does not confer any rights to use these trademarks, trade names, logos, or distinctive branding elements, whether for commercial or non-commercial purposes.

3. Registering with SQL Habit

  1. To use SQL Habit’s services, registration is required. Individuals over the age of 18 are eligible to register. Minors aged 14 or older may register only with the consent of their legal representatives. SQL Habit reserves the right to request proper proof of your identity, legal age, or legal representative’s consent as a condition for using its services.

  2. Registration for SQL Habit is free of charge (“Basic Account”) and does not obligate you to purchase a paid subscription. By registering, you agree to a limited, free use of the Platform. If your SQL Habit account has been provided by your employer, registering via the option communicated to you by your employer grants you immediate access to the content covered by the employer’s agreement with SQL Habit.

  3. You may register using your email address and a password of your choice. Alternatively, you can register through a single sign-on service (e.g., Google login). Registration is available via the SQL Habit website.

  4. All information provided during registration must be accurate, complete, and kept up to date.

  5. The password chosen during registration must be kept confidential. It is solely your responsibility to protect your password. Your SQL Habit user account is personal and may only be used by you. Any unauthorized use of your account or suspicion thereof should be reported to SQL Habit immediately.

4. Executing an Agreement for a Paid Subscription

  1. To fully access the features and benefits of SQL Habit, additional service packages in the form of paid subscriptions (“Subscription Access”) are available to you after registering. These can be purchased for different subscription periods, such as monthly or yearly plans, which will be displayed in the order options.

  2. SQL Habit’s Subscription Access provides comprehensive tools and resources to enhance your SQL learning experience. We currently offer the following subscription / service package:

    • The SQL Habit Premium subscription includes access to all available learning materials, exercises, and exclusive features offered through our web-based platform. You will retain access to these services as long as your subscription remains active and valid.
  3. If you choose to purchase your SQL Habit Premium subscription via our website, you are submitting a legally binding offer for a paid subscription by entering the requested information in the online order form and then clicking on the “Subscribe now” (or a similarly labeled) button.

  4. The agreement is finalized when SQL Habit, represented by Select From Count EU, issues a notice of acceptance (order confirmation), which will be sent to you by email within a reasonable timeframe. Upon purchasing your subscription through SQL Habit’s web platform, you will receive an order confirmation email along with a receipt confirmation immediately following your order. The text of the contract (consisting of the order, these Terms of Service, and the order confirmation) will be provided to you by SQL Habit via email, serving as the contract confirmation. Your subscription will commence on the date indicated in this email.

5. Trials/Testing Phases

  1. SQL Habit may occasionally offer free-of-charge access to the subscription service for testing purposes for a specific period of time (“Trial”). SQL Habit reserves the right, at its sole discretion, to determine eligibility for participation in a Trial. In cases of significant reason, SQL Habit may modify or discontinue such Trials at any time without prior notice or notification.

  2. Participation in certain Trials may require you to provide payment details during sign-up. By enrolling in such a Trial, you acknowledge and consent that your free access will automatically transition into a paid subscription on the day following the conclusion of the Trial. Your subscription will typically renew on a recurring basis unless canceled as described in Section 10 (2). Detailed information about this process will always be provided before you subscribe to a Trial.

  3. If you do not wish to continue with a paid subscription after the Trial (as described in Section 5 (2)), you must cancel your subscription before the Trial period ends. Cancellation can be easily done through your SQL Habit Profile page on the website.

  4. SQL Habit provides a 14-day money-back guarantee for subscriptions purchased directly through our website.

6. Individual Purchase of Content

  1. From time to time, we may offer you the option to purchase individual content on the SQL Habit platform to test our services without requiring a full subscription.

  2. By entering the requested information into the online order form and clicking the “Buy now” (or similar) button, you submit a legally binding offer for a paid contract for the selected individual content.

  3. The contract is deemed concluded when SQL Habit, operated by Select From Count EU (Anatoli Makarevich, Einzelunternehmen), issues a notice of acceptance (order confirmation), which will be sent to you via email within a reasonable timeframe. If you purchase the content through the SQL Habit web-based application or an online checkout provided by SQL Habit, you will receive an order confirmation via email along with a receipt and these Terms of Service.

  4. Upon your purchase of individual content, SQL Habit grants you a non-exclusive, non-transferable, non-assignable, non-sublicensable license to access and use the purchased content solely within the SQL Habit platform for your personal, non-commercial use. You are prohibited from altering, modifying, selling, transferring, sharing, leasing, decompiling, disassembling, reverse engineering, copying, reproducing, duplicating, distributing, publicly performing, creating derivative works from, commercially exploiting, or exporting the content outside the SQL Habit platform in any way.

7. Cancellation Policy

  1. If you are a consumer (i.e., a person completing the legal transaction for purposes that can be predominantly attributed to neither their commercial nor their independent professional activity), you are entitled to a statutory withdrawal right when concluding a distance selling agreement. SQL Habit provides information below in accordance with the statutory model. A model withdrawal form can be found in Section 7.3.

    Right of withdrawal

    You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period will expire after 14 days from the day of the conclusion of the contract.

    To exercise the right of withdrawal, you must inform us:

    of your decision to withdraw from this contract by an unequivocal statement (e.g., a letter sent by post or e-mail). You may use the attached model withdrawal form, but it is not obligatory.

    To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

    Effects of withdrawal

    If you withdraw from this contract, we shall reimburse to you all payments received from you without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

    If you requested to begin the performance of services during the withdrawal period, you shall pay us an amount which is in proportion to what has been provided until you have communicated to us your withdrawal from this contract, in comparison with the full coverage of the contract.

  2. The right of withdrawal expires with regard to individual content contracts if we have already provided you with the services (i.e., access to SQL Habit course content) with your prior consent before the end of the withdrawal period and your acknowledgment that you thereby lose your right of withdrawal.

  3. We hereby provide you with a sample withdrawal form, according to legal requirements:

8. Reimbursement and Payment Methods, Compensation and Retention Rights

  1. The Subscription Access for SQL Habit (monthly or yearly subscription) is subject to a fee. The subscription costs are to be paid at the beginning of the subscription period. If you are granted access to SQL Habit by your employer, your subscription access may be free of charge, as it is generally covered by your employer. Please note, however, that any additional services or products offered by SQL Habit, if available, may not be covered by your employer.

  2. SQL Habit accepts various payment methods, including credit card, PayPal, and any additional payment methods specified at the start of the order process.

  3. You are not entitled to offset any claims against claims of SQL Habit unless your counterclaims are legally established with binding effect or are undisputed. You may also offset against SQL Habit’s claims if you assert complaints for defects or counterclaims based on the same agreement.

  4. You may only exercise your right of retention if your counterclaim arises from the same agreement.

  1. The Service may contain links to third-party websites, advertisers, services, special offers, or other events or activities that are not owned or controlled by Select From Count EU. We do not endorse or assume any responsibility for any such third-party sites, information, materials, products, or services. If you access any third-party website, service, or content from SQL Habit, you understand that these Terms of Service and our Privacy Policy do not apply to your use of such sites. You expressly acknowledge and agree that Select From Count EU shall not be responsible or liable, directly or indirectly, for any damage or loss arising from your use of any third-party website, service, or content.

  2. In consideration for SQL Habit granting you access to and use of the Service and if you do not use a paid subscription, you consent to SQL Habit showing you promotional information on the platform. Our paid subscription service may occasionally include content that has been developed in collaboration with other companies.

10. Term and Cancellation

  1. Term of the Basic Account: The Basic Account starts from the time you register and remains active indefinitely. You may cancel your Basic Account at any time by deleting your account via the “Profile” menu on the SQL Habit web app.

  2. Term of the paid subscription: The paid subscription for SQL Habit runs for at least the term you originally selected (the “Initial Term”) and will automatically renew for an indefinite period (the “Indefinite Term”) unless canceled at least 24 hours before the end of that period. If you did not cancel during your Initial Term or did not cancel in time, you can cancel the Indefinite Term at any time by giving one month’s notice. You can cancel as follows: Log in on the SQL Habit website, navigate to the “Profile” menu, and click on “Cancel subscription.” If you cancel your Indefinite Term subscription before the end of each 12-month period, you can choose to keep your Premium access until the end of the 12-month period or we will refund the cost of unused months on a pro-rata basis to your selected payment method.

  3. Effective Date of Subscription Cancellation: Subscription cancellations take effect on the day following the last day of your current subscription period. After cancellation, your account will be automatically downgraded to a Basic Account. If your account was provided by your employer, it will be downgraded to a Basic Account after the contract between your employer and SQL Habit ends. Upon purchasing a new paid subscription, you can regain access to your previous subscription status and course progress. To delete your account entirely, including all data, you may do so through the “Profile” menu in the SQL Habit web app.

  4. SQL Habit’s Right to Cancel or Block Accounts: SQL Habit reserves the right to block or cancel your account for important reasons, such as a breach of these Terms of Service, without affecting the preceding provisions.

11. Gift Cards and Special Offers

  1. If you are the holder of a SQL Habit gift card that allows access to a SQL Habit subscription for the period mentioned in the accompanying email, card, or receipt, you have the right to use the SQL Habit platform during the specified period of time.

  2. To redeem the gift card, you must first register with SQL Habit (see Section 3) and then follow the URL indicated on the gift certificate.

  3. Gift cards and other promotional codes cannot be redeemed for cash, nor can they be reimbursed, exchanged, or used to purchase other gift cards or codes.

  4. Please note that in addition to these Terms of Service, if you use a gift card or any other special offer, additional terms and conditions may apply.

  5. Once the applicable period expires, subscription access will end automatically, and your account will be downgraded to a free account. If you wish to continue your subscription, you may sign up for a new subscription (see Section 4) at any time. If you wish to delete your entire account, this can be done through the account settings in our web application (see Section 10 (1)). All associated data will be deleted irrevocably.

12. Liability

  1. SQL Habit, operated by Select From Count EU, disqualifies any claims for damages from you. This does not apply to claims for damages arising from fatal injuries, physical injuries, health damage, or from the breach of essential contractual obligations (cardinal obligations), as well as liability for other damages that are based on an intentional or grossly negligent breach of duty by SQL Habit, its legal representatives, or affiliates. Essential contractual obligations are those whose fulfillment enables the proper execution of the Agreement in the first place and upon whose fulfillment you can reasonably rely.

  2. In the event of a breach of essential contractual obligations, SQL Habit shall only be liable for the typical, foreseeable damages stipulated in a contract if they were caused by negligence, unless they involve claims for damages due to fatal injuries, physical injuries, or damages to health.

  3. The restrictions mentioned in Section 12 (1) and 12 (2) also apply to breaches of duty by SQL Habit’s affiliates and legal representatives if claims are made directly against them.

13. Data Protection

  1. When you use SQL Habit, Select From Count EU processes your personal data. You can find out more in the SQL Habit Privacy Policy, which you can view here.

  2. If your SQL Habit subscription is provided to you via your employer, Select From Count EU processes your personal data partly on behalf of your employer. This means that your employer may be able to access, edit, delete, or control your account, as well as view insights into your usage behavior. Your employer can provide you with more detailed information regarding this.

14. Change of Terms and Conditions

  1. SQL Habit reserves the right to amend and/or supplement these Terms of Service (TOS) with effect for the future, provided that this is reasonable for you, taking into account SQL Habit’s interests. If no explicit consent is obtained from you to adapt the TOS, you will be notified by SQL Habit any amendments and/or supplements to the TOS in a timely manner (at least four weeks before the amended TOS enter into force). To this end, SQL Habit will send you the new version of the TOS to the e-mail address specified by you during registration. In this context, SQL Habit will expressly inform you of the possibility and deadline for an objection to the new version of the TOS, as well as the consequences should you not object.

  2. If you do not object to the applicability of the new version of the TOS within four weeks after receipt of the notification referred to in paragraph (1) of this Section, the new version of the TOS shall be deemed accepted by you.

  3. If you object to the new version of the TOS in due time, the contractual relationship shall continue under the previous TOS. However, SQL Habit may decide to terminate your subscription with effect from the next possible regular termination date.

15. Out-of-Court Dispute Resolution

For the out-of-court resolution of consumer disputes, the European Union has set up an Online Dispute Resolution (“OS Platform”) platform that can be accessed at http://ec.europa.eu/consumers/odr. The platform serves as a point of contact for the out-of-court resolution of disputes concerning contractual obligations arising from online agreements. According to § 36 VSBG (Verbraucherstreitbeilegungsgesetz, Consumer Dispute Resolution Act), Select From Count EU (legal entity behind SQL Habit) points out that Select From Count EU is neither obligated nor willing to participate in a dispute resolution procedure before a consumer arbitration board.

16. Final Provisions

  1. If any provision of these Terms of Service is deemed invalid, the remainder of the agreement shall remain in effect. In such cases, the statutory provisions shall replace the invalid terms.

  2. If you are an entrepreneur/businessperson as defined by § 14 BGB (German Civil Code), the following applies: The law of the Federal Republic of Germany shall govern these Terms of Service, excluding the provisions of the UN Convention on Contracts for the International Sale of Goods (CISG). If no exclusive jurisdiction is otherwise established, all disputes arising from or related to this agreement shall be exclusively settled in the court of jurisdiction corresponding to the residence of the SQL Habit’s owner, which is located in Berlin, Germany.
